License Agreement
This is a legal License Agreement between you and I, Danielle Theoret. If you do not agree to all the terms and and conditions of this License Agreement, select the button marked "Cancel" below. If you proceed to download any of the Models (three-dimensional digital coordinates) or Scenes files, you thereby signify that you have agreed to all the terms and conditions set forth below.
The Models and Scenes are protected by United States copyright laws, international treaty provisions and other laws. You may not use, copy, display, modify or distribute the models and scene except in strict accordance with this License Agreement.
I hereby grants to you the following worldwide, non-exclusive, non-transferable, non-sublicensable license with respect to it's rights in the models and scenes.
You may copy the models onto a storage device in an unlimited number of computers; provided that all such computers are physically located at your place of business located at a single specific street address (or its equivalent).
You may use and access the models and scenes on such computers only at that one location and only as follows: you may use, copy and modify the Models and Scenes in the creation and presentation of animations and renderings which may require runtime access to the Models and scenes, provided that you will neither:
a) separately market, distribute, transfer, sell or sublicense any Model or Scene or any part thereof, nor;
b) publish, market, distribute, transfer, sell or sublicense renderings, animations or any other product from which any Model or Scene or any part thereof can separately be exported, extracted, or decompiled into any redistributable form or format.
Subject to the foregoing limitations, and the rights, if any, of third parties in or to the objects represented by the Models and Scenes, you may copy and distribute your animations and renderings incorporating the Models and Scenes.
You may NOT publish or distribute any rendering of any Scene files (.max, .mb .awb, .vue and .br3 Scene files) in it's whole unaltered format, unless you put a clear mention on the image of the original author's name. You may use any Scene, in part or in whole, provided that the final rendering will be different from the original rendering done by me.
You may copy and redistribute your animations and renderings incorporating any of the 3d Models.
If you are a company, you may NOT publish your animations and renderings incorporating any of the 3d Models commercially, unless you have pay the 300$us fee for the company license.
You may NOT make available for download any Model or any Scene, nor store any Model or any Scene in a network where non-authorized person can get access to.
All the Plants and Trees in the Animatek World Builder Scene format (.awb) are copyrighted by Animatek International Inc and are subject to Animatek International Inc license agreement. You may NOT export or use any Plants or Trees included in any Animatek World Builder Scene format for reselling.
You must satisfy yourself that all the necessary rights and consents that may be required for your particular use of any Model or Scene thereof are obtained.
INFRINGEMENT WARRANTY. I warrants to you that, to the best of my knowledge, the digital data comprising the Models or Scenes, excluding the Plants in .awb Scene format, do not infringe the rights, including patent, copyright and trade secret rights, of any third party.
LIMITATION OF LIABILITY AND WARRANTIES. You assume the entire cost of any damage, losses or expense resulting from your use or exploitation of the models or Scene files. You assume all responsibilities for selection of the Models or Scenes to achieve your intended results, and for the installation of, use of, and results obtained from the Models and Scenes.
To the maximum extend permitted by applicable law, I hereby disclaims all warranties, express and implied, including but not limited to implied warranties or merchantability, noninfringement, and fitness for a particular purpose with respect to the Models and Scenes and any accompanying materials.
In no event shall I be liable for any special, incidental, or consequential damages, (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or third party claims) arising out of this license agreement or the use or inability to use the Models and Scenes or for any other reason, in any circumstances. In no event shall my liability to you for all damages in any one or more causes of action exceed the amount, if any, paid by you for the Models and Scenes.
This license Agreement is the entire agreement between you and I with respect to the Models and Scenes and supersedes any other communications or advertising, whether written or oral, with respect thereto. This License Agreement may not be modified or expanded except in a writing signed by me. If any provision of this License Agreement is held invalid or unenforceable, such right shall be immediately terminate.
